1. Who we are

This website, www.blackboxdonuts.co.uk (the “Site”), and the Black Box Donuts mobile app for iOS and Android (the “App”), are operated by Black Box Bakery Ltd, trading as Black Box Donuts. In these terms, “we”, “us” and “our” mean Black Box Bakery Ltd, and “you” means the person using the Site or App or placing an order.

2. About these terms

These Terms of Service govern your use of the Site and the App, and any order you place with us through either. By browsing the Site, downloading or using the App, or placing an order, you accept these terms. Please read them before you order.

Our Privacy Policy, Refund Policy, Shipping Policy and Purchase Options Cancellation Policy form part of these terms.

We may update these terms from time to time. The version that applies to your order is the one published at the moment you placed it. The date at the top of this page shows when it was last revised.

3. Placing an order

Everything shown on the Site and in the App is an invitation to order, not an offer. When you complete checkout, you're making an offer to buy. We'll send you an email acknowledging your order — this confirms we've received it, but it isn't acceptance.

A contract between us is formed only when we email you to confirm that your order has been dispatched.

We may decline an order. Reasons include a product being unavailable, a pricing or description error, our inability to deliver to your address, a failed payment or fraud check, or an order that appears to be for resale where no trade account is in place. If we decline an order after taking payment, we'll refund you in full without delay.

We may also limit the quantity of any product you can buy per order, per household or per address.

4. Prices and payment

Prices are shown in pounds sterling and include VAT where applicable. We are registered for VAT in the United Kingdom under number GB510657021. Delivery is charged separately and shown at checkout before you pay.

We take payment at the point of order through Shopify Payments and the wallet providers offered at checkout. We take reasonable care to make sure prices are correct, but if we discover a genuine pricing error before dispatch we'll contact you and give you the choice of confirming the order at the correct price or cancelling for a full refund.

Prices can change at any time, but changes won't affect orders we've already accepted.

Discount codes and promotions are subject to their own conditions, can't be used together unless we say so, have no cash value, and may be withdrawn at any time.

5. Allergens and food safety

This section matters. Please read it.

Our donuts are made in a kitchen that handles nuts (including hazelnuts, almonds and pistachios), peanuts, wheat, barley and other cereals containing gluten, milk, eggs and soya. Our ingredients, equipment and work surfaces are shared across our whole range. Despite the care we take with cleaning and separation, we cannot guarantee that any product is free from any allergen, and we cannot describe any product as suitable for someone with a severe or life-threatening allergy.

Ingredient and allergen information for each product is shown on that product's page, and is also listed together on our Ingredients page. Recipes and suppliers can change, so please check before every order rather than relying on a previous one. If anything is unclear, email customercare@blackboxdonuts.co.uk before you buy, and we'll answer honestly.

If you're ordering on someone else's behalf, or for an event, it's your responsibility to pass allergen information on to everyone who'll be eating the donuts.

Our products are fresh and unfrozen. Every box carries a best before date, and should be kept cool, dry and out of direct sunlight until eaten. If a delivery is delayed and your box reaches you on or past that date, please don't eat it — contact us and we'll put it right. Storage and best before advice is in our Shipping Policy.

6. Delivery

Delivery areas, costs, dispatch times and delivery arrangements are set out in our Shipping Policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Where you have asked for a parcel to be left in a safe place or with a neighbour, delivery is complete when it is left as instructed.

7. Cancellation, replacements and refunds

Because our donuts are freshly baked and perishable, the statutory 14-day right to cancel under the Consumer Contracts Regulations 2013 does not apply. You can cancel or change your order up to 24 hours before dispatch.

If something arrives damaged, spoiled, incomplete or incorrect, contact us within 48 hours of delivery. Our full process, and the remedies available to you, are set out in our Refund Policy, which forms part of these terms.

Where you buy on a subscription, how it renews and how you cancel it are set out in our Purchase Options Cancellation Policy, which forms part of these terms. Subscriptions are rolling, carry no minimum commitment, and can be cancelled by you at any time before the next payment is taken.

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

8. Gift cards

Gift cards can be redeemed against any purchase on the Site. They're non-refundable, can't be exchanged for cash, and can't be replaced if the code is lost or shared with someone else. Any balance remaining after a purchase stays on the card. Gift cards are valid for the period stated when issued, and for at least 12 months from the date of purchase.

9. Gifts and personalised messages

You can send donuts to someone else by entering their address as the delivery address at checkout.

We use Giftnote (giftnote.com) to deliver a personalised message to your recipient. If you use it, you'll give us their name and contact details so the message can be sent. By doing so you confirm you have their permission to share those details with us, and that we may contact them about the gift and its delivery.

Gift messages are shown to your recipient as written. We may decline to send a message that is unlawful, abusive, obscene or otherwise objectionable, and will contact you if we do.

Where an order is a gift, our contract is with you as the buyer, and it's you — not the recipient — who deals with us about cancellations, replacements and refunds. It's also your responsibility to pass on the allergen information in section 5.

10. Wholesale, corporate and event orders

Wholesale, corporate, event and pyramid orders are supplied on individually agreed terms, which we'll confirm to you in writing. Where those terms conflict with these Terms of Service, the individually agreed terms apply to that order.

Where you're buying in the course of a business, the consumer protections referred to in these terms do not apply to you, and our liability to you is limited as set out in section 16.

Products bought for resale may not be resold under any brand other than ours, or repackaged, without our written agreement.

11. Your account

You don't need an account to order, but if you create one you're responsible for keeping your login details secure and for anything done through your account. Tell us straight away if you think someone else has access to it. We may suspend or close an account that's being used in breach of these terms.

You must be 18 or over to place an order.

12. Our mobile app

The App is available for iOS through the Apple App Store and for Android through Google Play. Downloading and using it is free, though your network operator may charge you for data.

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, for your own use, on these terms. We keep ownership of the App and everything in it.

Your use of the App is also subject to the terms of the store you downloaded it from. Apple and Google are not parties to these terms, are not responsible for the App or its content, and have no obligation to provide support for it.

We may release updates and require you to install them so the App keeps working. We may also change, suspend or withdraw the App, or any feature of it, at any time. We'll give you reasonable notice before withdrawing it altogether unless we can't.

If you turn on push notifications, we'll use them to send order updates and, where you've opted in, offers and new product announcements. You can turn them off at any time in your device settings without affecting your ability to order.

Orders placed through the App are subject to these terms in exactly the same way as orders placed on the Site.

13. Acceptable use

You may use the Site and the App for lawful purposes only. You must not:

  • use the Site, the App or our products for any unlawful or fraudulent purpose;
  • upload or transmit viruses, malware or any other harmful code;
  • attempt to gain unauthorised access to the Site, the App, our servers or any connected system;
  • scrape, spider, crawl or systematically extract content from the Site or the App;
  • reverse engineer, decompile, modify or create derivative works from the App, except where the law expressly permits it;
  • copy, reproduce, resell or exploit any part of the Site or the App without our written permission;
  • submit false or misleading information, or impersonate anyone else;
  • harass, abuse, threaten or discriminate against our team or other customers, including in messages, reviews and social media contact.

We may refuse service, cancel orders, or restrict access to the Site or the App where these terms are breached.

14. Our brand and content

All content on the Site and in the App — photographs, product images, text, recipes, designs, graphics, logos and page layouts — belongs to us or is used under licence, and is protected by copyright, trade mark and design rights. You may not reproduce, distribute or use it commercially without our written permission.

“Black Box Donuts”, “Conuts”, “Donnollis” and “Little Dohs” are brand names of Black Box Bakery Ltd. Our Conuts product is protected by registered trade mark and registered design rights in the United Kingdom and Ireland. Copying, imitating or passing off these products will be enforced.

15. Reviews, photos and things you send us

If you send us reviews, photographs, videos, competition entries, ideas or suggestions, or tag us on social media, you keep ownership of your content but you give us a free, worldwide, non-exclusive licence to use, reproduce, edit, publish and share it in our marketing, on the Site, in the App and on our social channels, with credit to your name or handle where practical.

You confirm that anything you send is your own, doesn't infringe anyone else's rights, and isn't unlawful, offensive or defamatory. We're under no obligation to publish, keep confidential, pay for or respond to anything you send, and we may remove content at our discretion.

16. Our liability

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights under the Consumer Rights Act 2015, and under Part I of the Consumer Protection Act 1987.

If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for loss arising from your use of a product in a business context.

If you are a business customer: we exclude all implied warranties, conditions and terms to the fullest extent permitted by law. We are not liable to you for loss of profit, loss of business, business interruption, loss of anticipated savings, or loss of goodwill, whether direct or indirect. Our total liability to you in connection with any order is limited to the price paid for that order.

We take care to describe and photograph our products accurately, but colours and finishes vary between screens and between batches, and handmade products vary slightly from one another.

The Site and the App are provided “as is”. We don't guarantee they will always be available, uninterrupted or error-free, and we may suspend, withdraw or change any part of them without notice.

17. Events outside our control

We're not liable for any failure or delay in performing our obligations caused by an event outside our reasonable control — including severe weather, fire, flood, power or network failure, industrial action, carrier disruption, epidemic, or an act of government. If such an event occurs we'll contact you as soon as we can and either agree a new delivery date or refund you.

18. Third-party links and services

The Site and the App may link to third-party websites and use third-party services. We don't control them, we're not responsible for their content, and their inclusion doesn't mean we endorse them. Please read their own terms and privacy policies.

Our store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell to you.

19. Privacy

How we collect and use your personal information is set out in our Privacy Policy.

20. General

If any part of these terms is found to be unlawful or unenforceable, the rest continues to apply. If we don't enforce a right straight away, that doesn't mean we've given it up.

We may transfer our rights and obligations under these terms to another organisation, and we'll tell you in writing if we do. You may not transfer yours without our written agreement.

These terms are between you and us. No other person has any right to enforce them.

21. Governing law and disputes

These terms are governed by the law of Northern Ireland, and any dispute will be dealt with by the courts of Northern Ireland.

If you live elsewhere in the United Kingdom, or in the Republic of Ireland, you keep the benefit of any mandatory consumer protection law of the country you live in, and you may bring proceedings in the courts of that country.
